Is Worker’s Compensation Compulsory? Yes
Are Waivers Permitted? No
Numerical Exceptions: None.
Choice of Physician: Employee makes the initial choice of physician. However, if there is a managed care plan in effect, employee is obligated to see a physician in the plan network, unless a relationship has developed with a physician outside plan. Prior relationship is presumed if employee has seen the physician twice within the two years before the date of injury.
Waiting Period For Comp Benefits After Injury: 3 days (temporary total disability.)
Compensation is retroactive if disability continues for what period of time from the date of injury? 10 days
Attorney Fees Permitted: 25% first $4,000; 20% next $60,000, statute
